1. Acceptance of Terms

By accessing or using the NextMantra AI platform (recruiter.nextmantra.ai and related services), you agree to be bound by these Terms of Service (“Terms”). If you are using the platform on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

NextMantra AI provides an AI-powered recruitment platform that enables recruiters and hiring managers to:

Upload and screen resumes using AI-powered scoring.
Configure job requirements and candidate evaluation criteria.
Invite candidates to AI-conducted voice interviews.
Review structured evaluation reports and interview transcripts.

3. Account Registration

To use the platform, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@nextmantra.ai of any unauthorised use of your account.

4. Credits and Payment

The platform operates on a credit-based model. Credits are consumed when you run AI interviews or resume screening jobs.
Credits are purchased in advance and do not expire unless otherwise stated at the time of purchase.
All payments are processed securely through our payment provider. Prices are displayed in INR or USD depending on your selection and are inclusive of applicable taxes where required.
Credits are non-refundable once consumed. Unused credits may be eligible for refund within 30 days of purchase — contact us to request a refund.

5. Acceptable Use

You agree not to use the platform to:

Conduct interviews for roles that violate applicable employment discrimination laws, or to make hiring decisions based on protected characteristics.
Upload candidate data without obtaining the necessary consents from candidates as required by applicable data protection laws.
Upload malicious files, attempt to compromise platform security, or reverse-engineer the system.
Resell or sublicense access to the platform without written permission.
Use the platform for any unlawful purpose.

6. Candidate Consent & Compliance

You are solely responsible for ensuring that you have obtained all necessary consents and authorisations from candidates before uploading their data or inviting them to AI-conducted interviews. This includes complying with applicable employment laws and data protection regulations in your jurisdiction (including the DPDP Act 2023 in India and GDPR where applicable).

NextMantra provides the technical platform; it is not a party to your employment decisions and does not guarantee that use of the platform complies with the laws of your jurisdiction.

7. Data Ownership

You retain ownership of all data you upload to the platform, including job descriptions, resumes, and any content you create. You grant NextMantra a limited licence to process this data solely for the purpose of providing the services described herein.

AI-generated outputs (evaluation reports, interview transcripts, candidate scores) are made available to you as part of the service. You may use these outputs for your internal hiring decisions.

8. Intellectual Property

The NextMantra platform, including its software, design, AI models, and documentation, is owned by NextMantra AI and protected by intellectual property laws. These Terms do not grant you any ownership rights in the platform.

9. Service Availability

We aim to provide a reliable service but do not guarantee 100% uptime. We reserve the right to perform maintenance, updates, or suspend the service temporarily with reasonable notice. We are not liable for losses arising from service interruptions beyond our control.

10. Limitation of Liability

To the maximum extent permitted by applicable law, NextMantra AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the platform.

Our total cumulative liability to you for any claims arising under these Terms shall not exceed the amount you paid to NextMantra in the 3 months preceding the claim.

11. Termination

Either party may terminate the account at any time. You may delete your account from the platform settings. We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the breach. Upon termination, your access to the platform will cease and unused credits will be evaluated for refund on a case-by-case basis.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or a notice on the platform at least 14 days before taking effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.
